Mind Hack Lab End User License Agreement (EULA)

IMPORTANT NOTICE: THIS AGREEMENT INCLUDES A MANDATORY ARBITRATION CLAUSE AND A CLASS ACTION WAIVER.

By clicking “Accept,” registering, or using the Mind Hack Lab Application (the “Application”), you agree to comply with and be bound by this End User License Agreement ("EULA"). If you do not agree, please discontinue use immediately.

1. Definitions:

• "Mind Hack Lab", "we", "us", or "our" refers to Mind Hack Lab.
• "Application" means the Mind Hack Lab mobile or web-based platform offering Single-Session Intervention (SSI) services.
• "Services" refer to AI-driven self-help sessions aimed at emotional and psychological well-being.
• "Content" means information and materials provided through the Application.
• "User" or "you" means the individual using the Application.

2. Eligibility:
You must be at least 18 years old to use the Application. We do not knowingly collect information from individuals under 18. If we learn that we have collected data from someone under 18, it will be deleted promptly.

3. User Consent:

• Electronic Communication: You consent to receive electronic communications via email, SMS, or notifications essential for the Application's function.
• Privacy & HIPAA Compliance: Mind Hack Lab adheres strictly to HIPAA standards to protect your Protected Health Information (PHI). Your data will be securely stored and used in compliance with our Privacy Policy.

4. User Representations & Obligations:
You represent and warrant:

• You are at least 18 years old.
• Your provided information is accurate.
• You will not misuse the Application or engage in prohibited activities, such as unlawful actions, harassment, reporting false emergencies, unauthorized data extraction, or introducing malicious software.

5. Account Registration & Security:
You agree to maintain accurate and updated information, protect your login credentials, and notify Mind Hack Lab immediately of any unauthorized account use. We recommend enabling Multi-Factor Authentication (MFA).

6. Ownership & License:
Mind Hack Lab retains all intellectual property rights to the Application, Services, and Content. You receive a personal, limited, revocable, non-exclusive license to use the Services solely for your individual, non-commercial purposes.

7. User Information & Feedback:
You retain rights to your information ("User Information"). You grant Mind Hack Lab a non-exclusive, worldwide, royalty-free license to use this information as necessary for providing and improving our Services, consistent with our Privacy Policy.

8. Subscription & Payments:
Subscription fees for Services are listed clearly within the Application. Fees are non-refundable unless specifically noted otherwise. Mind Hack Lab may use third-party payment processors and is not responsible for errors or fees imposed by such processors.

9. Termination:
Mind Hack Lab may suspend or terminate your account or access to Services at its discretion. You may terminate this EULA by discontinuing use and uninstalling the Application. No refunds will be provided upon termination.

10. Disclaimers & Limitations:
Mind Hack Lab provides no medical diagnosis, treatment, or emergency services. The Services are provided "AS IS," and Mind Hack Lab expressly disclaims any warranties regarding accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. Mind Hack Lab’ maximum aggregate liability to you shall not exceed USD $100.

11. Indemnification:
You agree to indemnify and hold harmless Mind Hack Lab and its affiliates from any claims, liabilities, or expenses arising from your use or misuse of the Services, violation of this EULA, or infringement of any third-party rights.

12. Governing Law & Arbitration:
This EULA is governed by the laws of the State of Delaware. Any disputes will be resolved through binding arbitration conducted by JAMS in accordance with their rules, in New York. You waive any right to participate in class actions.

13. Miscellaneous:

• Severability: If any provision of this EULA is invalid or unenforceable, the remainder will remain valid and enforceable.
• Assignment: You may not assign your rights or obligations under this EULA.
• Entire Agreement: This EULA constitutes the entire agreement between you and Mind Hack Lab regarding its subject matter.
